In 2023, human rights defender Bahrom Hamroev was sentenced to 13 years and 9 months in prison under articles on calls to terrorism and participation in the activities of a terrorist organization.
Memorial considers Bakhrom Hamroev a political prisoner.
About the case:
Bahrom Hamroev is a human rights defender and head of the Yerdam Foundation for Legal and Social Support for Migrants. He was a member of the Memorial Human Rights Center before the liquidation of his juridical entity.
On February 24, 2022, a search was conducted in Hamroev's apartment based on the case of public calls for terrorism on the Internet (Part 2 of Article 205.2 of the Criminal Code). The ground for the charges were six posts on his personal Facebook page. According to the FSB, the human rights defender "propagandized terrorism" and posted on his personal page materials allegedly related to the activities of the Islamic party Hizb ut-Tahrir, banned in Russia.
In October, the FSB opened a second criminal case against Bahrom. He was also charged under the article on organizing the activities of a terrorist organization (Part 1 of Article 205.5 of the Criminal Code). The investigation considered a report on political persecution, as well as complaints and petitions to the courts, including the ECHR as such “terrorist” activities.
On May 23, 2023, Khamrayev was sentenced to 14 years in prison. The court found him guilty under articles on calls to terrorism and participation in the activities of a terrorist organization. On October 10, the Military Court of Appeal reduced the sentence by three months to 13 years and 9 months in prison.
On August 21, 2023, the lawyers of the Memorial Center sent an appeal in support of Bahrom Hamroev to the UN special Rapporteurs.
On October 25, 2023, the appeal of Memorial's lawyers was communicated. The Special Rapporteurs expressed concern about the persecution of the human rights defender and put forward a number of questions to Russia regarding this case. Russia had 60 days to answer the questions, but no response followed.
